Eligibility
By using our services, you represent and warrant that:
You are at least 18 years old or otherwise have the legal capacity to enter into a binding agreement.
All information you provide to us is accurate, complete, and current.
You will keep your account information updated at all times.
We reserve the right to suspend or terminate accounts that contain false, misleading, incomplete, or unverifiable information.

Services
Akamoi provides digital infrastructure and related services on an as-available basis. Service specifications, pricing, features, and limitations are described on our website, billing portal, invoices, or service order forms.
We reserve the right to:
modify, improve, or discontinue any service at any time;
change service pricing, specifications, or availability;
impose or adjust usage limits, fair use restrictions, or technical controls where necessary for stability, security, compliance, or abuse prevention.

Account Registration and Security
You are responsible for:
maintaining the confidentiality of your account credentials;
all activities carried out under your account;
ensuring that your systems, passwords, applications, and access methods are secure.
You must immediately notify us of any unauthorized access, suspected compromise, or security incident involving your account or services.
Akamoi is not responsible for losses resulting from your failure to secure your credentials or systems.

Billing and Payment
All services are billed in advance unless otherwise stated.
By purchasing a service, you agree that:
fees are due on or before the invoice due date;
failure to pay on time may result in suspension or termination of service;
unpaid invoices may be subject to late fees, collection action, or service-related restrictions where permitted;
you are responsible for any taxes, levies, duties, or government charges applicable to your purchase, unless otherwise stated.
Unless otherwise specified, invoices that remain unpaid after the due date may result in:
temporary suspension of service;
loss of access to data or services;
termination of the service after the overdue period.
Akamoi does not guarantee restoration of suspended or terminated services unless restoration is technically possible and all outstanding balances are settled.

Renewals and Cancellations
Some services renew automatically unless cancelled before the next billing cycle. It is your responsibility to review your billing settings and submit cancellation requests in advance.
Cancellation requests must be submitted through the client area or another official method recognized by Akamoi. A cancellation request is not considered valid simply because you stopped using the service.
No cancellation relieves you from paying charges already incurred.

Acceptable Use
You agree not to use our services for any unlawful, abusive, harmful, or fraudulent activity.
Prohibited activities include, but are not limited to:
sending spam, unsolicited bulk email, or abusive messaging;
phishing, spoofing, fraud, or deceptive conduct;
hosting malware, ransomware, spyware, or malicious code;
unauthorized access, scanning, intrusion attempts, or exploitation of systems;
botnet activity, DDoS attacks, or any activity that disrupts networks or systems;
child exploitation material, unlawful pornography, or illegal content;
copyright infringement or intellectual property violations;
distributing content that violates applicable law;
using services in a way that threatens the security, integrity, or performance of our infrastructure or third-party networks.
We may investigate suspected violations and take action including suspension, null-routing, restriction, data preservation, reporting to authorities, or termination of services.

Email and Network Abuse
If email-related services, SMTP access, or outbound mail capability are provided, you agree that:
mail usage must comply with all applicable laws and anti-spam requirements;
mailing lists must be permission-based and verifiable;
transactional email must be legitimate and tied to lawful activity;
we may monitor, rate-limit, suspend, or disable email capability to prevent abuse.
We reserve the right to require identity verification, usage justification, rDNS/SPF/DKIM/DMARC setup, or other compliance measures before enabling certain network capabilities such as SMTP or special ports.

Resource Usage and Fair Use
Services are subject to the technical limits of the plan purchased.
You may not:
consume excessive CPU, RAM, disk I/O, bandwidth, or network resources in a manner that negatively affects other customers or platform stability;
use services beyond their intended or allocated limits without authorization;
resell or redistribute services contrary to the product terms.
We may throttle, suspend, upgrade, or require migration of workloads that exceed normal or allowed use.

Backups and Data Responsibility
Unless explicitly included in your service, backups are not guaranteed.
You are solely responsible for:
maintaining independent backups of your data;
verifying backup integrity;
ensuring you can restore your systems and data when needed.
Akamoi is not liable for data loss, corruption, deletion, failed backups, or inability to recover data, regardless of cause.

Service Availability
We aim to provide reliable service, but we do not guarantee uninterrupted, error-free, or always-available operation unless stated in a separate written Service Level Agreement.
Scheduled maintenance, emergency maintenance, upstream issues, hardware faults, software bugs, attacks, force majeure events, and third-party failures may affect service availability.

Suspension and Termination
We may suspend, restrict, or terminate services immediately, with or without notice, if:
you violate these Terms or our policies;
payment is overdue;
your use creates security, legal, operational, or reputational risk;
required verification or compliance information is not provided;
we are required to do so by law, court order, regulation, payment provider, datacenter, or upstream provider.
Upon termination, your right to use the service ceases immediately. We may delete data after termination or after any grace period, if applicable.

Intellectual Property
All content, branding, trademarks, logos, website materials, software, and platform elements owned by Akamoi remain our property or the property of our licensors.
These Terms do not grant you any ownership rights in our intellectual property. You may not reproduce, copy, modify, distribute, reverse engineer, or exploit our proprietary materials except as permitted by law or with written authorization.

Customer Content
You retain ownership of your content and data. However, you grant us the limited rights necessary to host, transmit, process, back up, secure, and administer your services.
You represent that your content does not violate any law or third-party rights.
We may remove or disable access to content where reasonably necessary to comply with law, enforce these Terms, or protect our systems and third parties.

Third-Party Providers
Some services may rely on third-party datacenters, registrars, cloud providers, software vendors, payment processors, and network providers.
Akamoi is not responsible for the acts, omissions, outages, restrictions, pricing changes, or policy changes of third-party providers. Your use of certain services may also be subject to those providers’ rules or technical limitations.

Limitation of Liability
To the maximum extent permitted by law, Akamoi shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, business, goodwill, data, or opportunities.
Our total liability for any claim relating to the services shall not exceed the amount you paid to us for the affected service during the three (3) months immediately preceding the event giving rise to the claim.

No Warranty
All services are provided on an “as is” and “as available” basis, except where a specific written agreement states otherwise.
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Indemnification
You agree to defend, indemnify, and hold harmless Akamoi, its owners, staff, contractors, affiliates, and partners from and against any claims, damages, liabilities, losses, penalties, and expenses arising out of:
your use of the services;
your breach of these Terms;
your content, data, or activities;
your violation of law or third-party rights.

Compliance and Verification
We may request verification documents or additional information for fraud prevention, regulatory compliance, abuse handling, payment verification, or service enablement.
Failure to provide requested information within a reasonable period may result in service restriction, cancellation, or refund review at our discretion.

Changes to Terms
We may update these Terms from time to time. Updated versions become effective when posted on our website or otherwise communicated to customers.
Your continued use of the services after changes take effect constitutes acceptance of the revised Terms.

General Policy
Because many of our services are digital, provisioned instantly, capacity-based, or involve non-recoverable upstream costs, not all purchases are refundable.

Eligible Refund Requests
Refunds may be considered in the following cases:
duplicate payments;
accidental multiple orders for the same service;
failure to provision the service within a reasonable time due to an issue on our side;
billing error caused by Akamoi;
cancellation of a qualifying service within the applicable refund window, if such refund window is stated for that service.
All approved refunds are issued at our discretion unless otherwise required by law.

Non-Refundable Services
Unless otherwise required by law or explicitly stated in writing, the following are generally non-refundable:
VPS hosting services after provisioning;
cloud instances after provisioning;
dedicated resources or dedicated servers;
domain registrations, renewals, transfers, and restoration fees;
software licenses;
setup fees;
add-ons, custom configurations, or managed service work already performed;
services suspended or terminated for abuse, policy violations, fraud risk, or non-compliance;
charges incurred due to overages, upgrades, add-ons, or custom work;
partial billing periods and unused service time.

Refund Window
If Akamoi offers a refund window for a specific product, it will be stated on the product page, invoice, service description, or official written communication.
If no refund window is stated, the service is considered non-refundable once provisioned.

Abuse, Fraud, and Policy Violations
No refunds will be issued where we determine, in our reasonable discretion, that the order or account involves:
spam activity;
abusive or prohibited activity;
chargeback risk;
fraud indicators;
false or misleading registration details;
violation of our Terms and Conditions or Acceptable Use rules.
We reserve the right to withhold refunds pending investigation or verification.

Refund Request Procedure
To request a refund, you must submit a ticket through the official client area or approved support channel and include:

invoice number or order number;

the reason for the refund request.
Submitting a cancellation request does not automatically guarantee a refund.

Chargebacks and Payment Disputes

If a chargeback or dispute is initiated without prior effort to resolve the matter, we reserve the right to:
suspend or terminate your services;
restrict future orders;
provide supporting records to the payment provider;

Processing Time
Approved refunds are typically processed back to the original payment method within a reasonable period. Actual posting time depends on the payment processor, bank, card issuer, or platform involved.
We are not responsible for delays caused by financial institutions or third-party processors.

Partial Refunds and Credits
